
Court sentences man to death in Ibadan over rape and murder case
A High Court in Ibadan has sentenced Kolade Tosin (24) to death by hanging for the rape and killing of a 17-year-old girl.
Delivering judgment, the court held that the defendant’s denial of his earlier statement to police was inconsistent and amounted to an afterthought, stating that a litigant cannot “blow hot and cold at the same time.”
According to the judge:
“It is settled principle of the law that a litigant will not be allowed to blow hot and cold at the same time.”I hold in agreement with the prosecution that the defendant’s denial of making a statement to the police later in his defence is an afterthought and cannot avail him.”
The defendant gave a graphic detail of his cr+mes. He told the police that he forcefully had s+xual intercourse with the deceased, thus signifying that she did not give her consent.”
I therefore hereby sentence you, Kolade Tosin, to d+ath, by hanging on the neck until pronounced d+ad. May God have mercy on your soul.
